Generative AI products include ChatGPT for text, Dall-E for imagery, deepfakes for videos, avatars in social media feeds, Google’s Music LM and Jukebox for music generation, software code generation, and more. These tools are moving rapidly from experimental to core features of ubiquitous software products, including Microsoft Office and Google. This change has significant implications to teaching and learning across most fields. Beyond pedagogy, the introduction of generative AI has important legal and ethical implications regarding copyright, privacy laws, antidiscrimination laws, ADA compliance, and much more. This discussion will explore the legal, ethical, and academic policy considerations regarding the use of generative AI by students, faculty, and institutions.

Learning Objectives 

  • Examine the range of generative AI services and how they relate to curriculum across different academic disciplines.
  • Identify the legal risks associated with developing and deploying generative AI.
  • Evaluate the legal obligations to use generative AI in certain instances for compliance with ADA and Rehabilitation Act while limiting its use to comply with FERPA and other privacy obligations.
  • Select strategies that harness the potential of generative AI in a manner consistent with academic learning goals, ethical considerations, and legal limitations.
